Contest Name: Progressive Talk Radio Star Web Contest (herein defined as the “Web Contest”)

Center for American Progress, and its affiliated companies (together, “American Progress”), will conduct the Web Contest substantially as described in these rules, and by submitting an entry, each participant agrees as follows:

1. Description of Web Contest/Participation. The Web Contest will seek to identify several potential talk show hosts who can effectively discuss progressive views on public policy issues in a talk-radio format (each, a “Contestant”). No Contestant will use his/her participation in the Web Contest to: (1) attempt to influence the outcome of any specific public election; (2) participate or intervene in (including the publishing or distributing of statements) any political campaign on behalf of (or in opposition to) any candidate for public office; or (3) support or oppose a political party or political organization. One Contestant will be chosen as a winner and will receive the prizes described in Section 2. All entries must follow all guidelines and rules, as set forth herein, to be eligible.

Dates of Contest : The Web Contest will begin on or about Monday October 9, 2006 and end on or about Tuesday October 31, 2006.

Entry Guidelines : All contestants must fill out an online registration form, confirm that they agree to the terms and conditions of the contest rules and site usage, fill the online profile form and upload an audio demo that will first be reviewed by the online judges. If selected the entry will be published for visitors of the site to view and hear. Recordings must be no more than 10 minutes in length, with a file size no larger than 10 megabytes. Audio must be submitted as a Windows Media audio only file or MP3 audio only file. YOUR SUBMITTED RECORDING WILL NOT BE RETURNED. Detailed entry methods are more particularly described below.

Incomplete or multiple entries will be disqualified. All entries must be received by 11:59 p.m. Eastern on October 16, 2006 to be eligible for consideration. All Contestants must be at least 18 years old and an “Amateur” defined as someone who has not received five (5) percent of their income in any given year from their participation in a radio broadcast (disputes will be resolved in the sole discretion of American Progress). All entries jointly become the property of American Progress and will not be returned. Contestants may submit only one (1) voiced performance for the Web Contest and may not have entered the Progressive Talk Star Local Contest conducted by Clear Channel Broadcasting, Inc. (the “Local Contest” or “Local Contests”).

How to Enter : Participants may enter by logging onto and following the Web Contest links and instructions to enter . Deadline for registration is 11:59 p.m. Eastern on October 16, 2006.

Judging : Judges will select the ten Contestants and along with votes cast by website visitors a winner of the Web Contest based on their ability to effectively discuss progressive views on public policy issues and in a talk-radio format, including their Presentation, Vocal Quality, Accuracy, Interpretation and "IT"-factor Qualities. All decisions of the judges are final. American Progress will select one winner to receive the prizes described in Section 2.

2. Prizes. The prizes that may be awarded to the eligible winner are:

  • A Grand Prize of $1,000.
  • Entry into the National Progressive Talk Show Contest (herein after the “National Contest”), starting Wednesday November 1, 2006.
  • Should the winner of the Web Contest be chosen as a finalist in the National Contest, he/she will also receive at trip package to compete in the National Contest, provided by Media Syndication Services, Inc. The trip package will include round-trip airfare for two to Washington D.C. ; hotel accommodations for 2 days and 2 nights; ground transportation provided at destination. Finalists for the National Contest must be available to travel between November 13, 2006 and November 17, 2006 . Prize value may vary depending upon departure location and time of travel. Other restrictions may apply. All airport and travel taxes are the sole responsibility of the winner . Additionally, other guidelines and rules will be provided prior to commencement of the National Contest .

Prizes are not transferable, redeemable for cash, or exchangeable for any other prize. All prizes must be redeemed within sixty (60) days of the Web Contest end date. No cash equivalent for prizes will be awarded. Prizes are nontransferable. If a winner cannot be contacted or is disqualified, the American Progress reserves the right to determine an alternate winner or not to award that winner’s prizes, in its sole discretion.

3. Eligibility and Limitations. Participants and winner(s) must be U.S. residents at least 18-years old as determined by the Company and an Amateur. Only one (1) entry per person in either the Web Contest or Local Contests. All entries will be individual persons: no duo or teams are allowed. Only one (1) prize per household for the Web Contest or Local Contests. Employees of American Progress, participating sponsors of the Local, Web, or National Contests, and their advertising agencies, employees of radio or television stations, and members of the immediate family of any such persons are not eligible to participate and win. The term “immediate family” includes spouses, siblings, parents, children, grandparents, and grandchildren, whether as “in-laws,” or by current or past marriage(s), remarriage(s), adoption, co-habitation or other family extension, and any other persons residing at the same household whether or not related.

4. Delivery Disclaimer. Participants are restricted to the use of ordinary recording equipment. American Progress disclaims all liability for the inability of a participant to complete or continue an entry or submission of an entry due to equipment malfunction, busy lines, inadvertent disconnections, acts beyond American Progress’s control, or otherwise. For all contests, American Progress disclaims all liability for any delays, misdelivery, loss, or failure in the delivery of any item sent by mail, courier, express, electronic transmission, or other delivery method. American Progress is not responsible for mechanical, technical, electronic, communications, telephone, computer, hardware or software errors, malfunctions or failures of any kind, including: failed, incomplete, garbled or delayed transmission of online entries, traffic congestion on telephone lines, the Internet or at any website or lost or unavailable network connections which may limit an online entrant's ability to participate in the Web Contest, and any injury or damage to an entrant’s or any other person’s computer related to or resulting from participating in or downloading any information necessary to participate in the Web Contest. Entry forms in a register-to-win contest must be handwritten.

5. Publicity; Use of Personal Information. By participating, where allowed by law, all participants and winner(s) grant and American Progress exclusive permission to use their names, characters, photographs, voices, and likenesses in connection with promotion of this and other contests and waive any claims to royalty, right, or remuneration for such use. By participating in the Web Contest, where allowed by law, participants agree that American Progress may disclose personal information obtained from participants in the Web Contest to third parties and use such information for marketing and other purposes.

6. Release. By participating in the Web Contest, each participant and winner waives any and all claims of liability against Nakea, LLC., and American Progress, its employees and agents, the Web Contest’s sponsors and their respective employees and agents, for any personal injury or loss which may occur from the conduct of, or participation in, the Web Contest, or from the use of any prize. In order to receive a prize, participants must sign an official waiver form provided by American Progress.

7. Taxes. Any valuation of the prize(s) stated above is based on available information provided to American Progress, and the value of any prize awarded to a winner may be reported for tax purposes as required by law. Each winner is solely responsible for reporting and paying any and all applicable taxes related to the prize(s) and paying any expenses associated with any prize that are not specifically provided for in the official rules. Each winner must provide American Progress with valid identification and a valid taxpayer identification number or social security number before any prize will be awarded. Any person winning over $600 in prizes from American Progress will receive an IRS form 1099 at the end of the calendar year and a copy of such form will be filed with the IRS.

8. Conduct and Decisions. By participating in the Web Contest, participants agree to be bound by the decisions of American Progress personnel. Persons who violate any rule, gain unfair advantage in participating in the Web Contest, or obtain winner status using fraudulent means will be disqualified. Unsportsmanlike, disruptive, annoying, harassing or threatening behavior is prohibited. American Progress will interpret these rules and resolve any disputes, conflicting claims or ambiguities concerning the rules or the Web Contest and American Progress’s decisions concerning such disputes will be final. If the conduct or outcome of the Web Contest is affected by human error, any mechanical malfunctions or failures of any kind, intentional interference or any event beyond the control of American Progress, American Progress reserves the right to terminate this Web Contest, or make such other decisions regarding the outcome as American Progress deems appropriate. All decisions will be made by American Progress and are final. American Progress may waive any of these rules in its sole discretion.

9. Miscellaneous. Each winner must submit proof of eligibility and sign American Progress’s release form to claim the prize. American Progress may substitute prizes, amend the rules or discontinue the Web Contest at any time. American Progress disclaims any responsibility to notify participants of any aspect related to the conduct of the Web Contest. For a copy of the rules, or where required by law, a list of winners, mail a written request with a stamped, self-addressed return envelope to: Progressive Talk Star Web Contest, Center for American Progress, 1333 H St., NW, Washington D.C., 20005. All entries become the property of American Progress and will not be returned.


10. Compliance with Law. The conduct of the Web Contest is governed by the applicable laws of the District of Columbia , which take precedence over any rule to the contrary herein. American Progress will follow the applicable laws for conducting contests, including notice to the District of Columbia attorney general or consumer affairs office, posting of a prize bond, furnishing lists of winners, advertising specific disclaimers, providing specific written information about the Web Contest, etc. as required by District of Columbia law.
